Terms of Service

Kenosabe is made by Voltaic Software LLC ("we" or "us"). These terms cover kenosabe.com, the Kenosabe hall software and kiosk, the Kenosabe player app at play.kenosabe.com, and the Kenosabe TV app for Fire TV and Android TV. By buying a plan or using any of them, you agree to these terms. Our Privacy Policy explains how we handle your data.

Kenosabe disclaimer

Kenosabe is intended for entertainment purposes only. Operators are solely responsible for ensuring that all use and operation comply with any and all applicable federal, state, and local laws, rules, and regulations governing bingo, electronic gaming, and gambling, including all licensing and permit requirements. This disclaimer does not authorize any activity prohibited by law or exempt any operator from applicable legal requirements. Void where prohibited.

Who these terms are for

"Operator" means the bar, hall, restaurant or other venue that buys a Kenosabe plan, and the staff it lets use its account. "Player" means anyone who follows a game on the player app or in the room. You must be 18 or older, or the legal age where you live if it is higher, to buy a plan or use the hall software.

The operator's responsibilities

• Run every game in line with the laws of your state and locality, including any limits on how often games are held, entry fees, prizes and player ages, and get any license or permit those laws require.
• Provide, award and pay out all prizes yourself. Kenosabe does not hold, pay or guarantee any prize.
• Keep your account sign-in private and tell us right away if you think someone else has used it. You are responsible for what happens under your account.
• Don't use Kenosabe for anything illegal, don't try to break into or disrupt it, and don't copy, resell or reverse engineer it.

Information we publish about state rules, including our state pages and FAQ, is general information and not legal advice. Check with your own lawyer or regulator before running games.

Players

The player app is free and needs no account. It lets you follow cards the venue gives you. Nothing can be bought, sold or wagered in the player app or the TV app. Questions about a game, a card or a prize go to the venue running it.

Plans and payment

Plans and prices are listed at kenosabe.com. Weekly plans are billed every week and monthly plans every month, in advance, to the card you give at checkout. Payments are handled by Stripe. Your plan renews automatically until you cancel. One-time items, such as the launch setup package, extra displays and equipment, are charged once. Prices may change; we'll tell you at least 30 days before a change applies to your plan.

Canceling

You can cancel any time by emailing sales@kenosabe.com. Canceling stops future charges, and your plan stays active until the end of the period you've already paid for. Plan fees already charged aren't refunded unless the law requires it. Equipment you've bought is yours to keep.

Our software

We give you a limited, non-exclusive, non-transferable right to use Kenosabe at your venue while your plan is active. We own Kenosabe, including its software, themes, art and the Kenosabe name. We may improve or change features over time. We may suspend or close an account that breaks these terms or doesn't pay, and we'll tell you why.

No warranty

We work to keep Kenosabe running smoothly, but it is provided "as is" and "as available." To the extent the law allows, we make no warranties of any kind, including that it will be uninterrupted, error-free, or fit for a particular purpose. Internet, power, device and TV problems at your venue can affect a game; have a backup plan for your game night.

Limit of liability

To the extent the law allows, Voltaic Software LLC is not liable for any indirect, incidental, special or consequential damages, or for lost profits, revenue or data, and is not liable for any prize, payout or dispute between an operator and its players. Our total liability for any claim is limited to the amount you paid us in the three months before the claim arose.

Indemnity

Operators agree to defend and hold harmless Voltaic Software LLC from claims, fines and costs that come from how they run their games, including any failure to follow the laws that apply to them.

Governing law

These terms are governed by the laws of the State of Ohio, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Ohio.

Changes and questions

If these terms change, we'll post the new version here with a new effective date. If the change is significant, we'll also email operators. Using Kenosabe after a change means you accept the new terms. Questions? Email sales@kenosabe.com or call 216-245-7437.
